You must be at least 16 years old to use PeakEvolv. By using the App, you represent that you meet this requirement and are legally capable of entering into this agreement under applicable law.

2. Description of Service

PeakEvolv is a fitness and nutrition tracking application that helps users manage their workouts, monitor nutrition intake, and track progress toward health goals.

Features include (but are not limited to):

• Workout and exercise logging
• Nutrition and calorie tracking
• Progress tracking and analytics
• Data storage and cloud synchronization
• Custom reminders and notifications

We may modify or update the Service from time to time, including adding or removing features, without prior notice.

3. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

4. Subscription and Payment

• PeakEvolv operates on a subscription model with optional free trials.
• New users may receive a 7-day free trial of premium features.
• After the trial period, continued access to premium features requires an active subscription.
• Subscription fees are displayed in-app and may vary by region.
• Payments are processed through the platform’s (Google Play / Apple App Store) billing systems.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Refunds are handled according to the respective app store policies.
• PeakEvolv may change pricing or introduce new plans, with reasonable prior notice to existing subscribers.

5. Free and Premium Features

Free users have access to limited features such as:

• Workout logging
• Progress photos and weight tracking
• Basic dashboard and reminders

Premium subscribers gain access to additional features such as:

• Nutrition and calorie tracking
• Meal templates and analytics
• Cloud synchronization and data export
• Advanced insights and customization

We may modify which features are included in free or premium tiers at our discretion.

6. Data Storage and Privacy

• PeakEvolv values your privacy.
• User data is primarily stored locally on your device, with optional synchronization through Supabase, a secure cloud storage service.
• We do not sell or share your personal data with third parties for advertising purposes.
• By using the App, you consent to the collection and processing of your data as described in our Privacy Policy.
• You are responsible for maintaining backups of your own data.

7. Health Disclaimer

• PeakEvolv is a wellness and fitness tracking tool and does not provide medical advice.
• The information provided through the App is for educational and motivational purposes only.
• Consult a physician or qualified healthcare provider before starting any new exercise or nutrition plan.
• We are not responsible for any injuries, health conditions, or damages resulting from actions taken based on the App’s data or recommendations.

8. User Content

You may upload, log, or create content (e.g., custom meals, workout routines, photos). You retain ownership of your content but grant PeakEvolv a non-exclusive, worldwide, royalty-free license to store, display, and process it solely to provide the Service.

You are responsible for ensuring that:

• You have rights to the content you upload.
• It does not infringe on third-party rights or contain illegal material.

9. Prohibited Activities

• Use the App for unlawful purposes.
• Attempt to reverse engineer, copy, or modify the software.
• Upload malicious code or engage in data scraping.
• Share, sell, or resell access to your account.

Violation of these terms may lead to suspension or termination of your account.

10. Limitation of Liability

To the maximum extent permitted by law, PeakEvolv and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, any data loss, unauthorized access, or service interruption. Your sole remedy for dissatisfaction with the Service is to stop using it.

11. Indemnification

You agree to indemnify and hold harmless PeakEvolv, its founders, employees, and partners from any claims, damages, or liabilities arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.

12. Termination

We may suspend or terminate access to your account at any time, with or without notice, if you violate these Terms or engage in misuse of the Service. Upon termination, your right to use the App will immediately cease.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

14. Changes to These Terms

We may update or revise these Terms at any time. Changes will take effect once published in the App or on our website. Continued use of the App after changes implies acceptance of the updated Terms.
